He put forth the argument to a sympathetic judge (the Honoroable Jeremy Fogel, Clinton appointee) of the US 9th Circuit Court of Appeals. Senior's argument, in a nutshell, is that lethal injection using a 3 drug "cocktail" might possibly cause the person under sentence pain during the process. The pain, as the person's breathing / heart are stopped and the brain dies from oxygen deprivation might occur if the first drug is not sufficient enough to completely sedate the prisoner. This pain becomes "cruel and unusual punishment" and thus violating the prisoner's constitutional rights.&lt;br /&gt;&lt;br /&gt;Judge Fogel method to resolve the impass forced the medical establishment into the capital case with modifications to Protocol 770 and thus, with one fell stroke of a pen, has put capital punishment on hold for the entire United States. 770 is a well thought out and oft reviewed and affirmed.   It is the pattern for most states using lethal injection as a method of execution.  I guess that Starrie Decisis is only an appropriate judicial philosophy for laws that liberals view as legal and just.&lt;br /&gt;&lt;br /&gt;What everyone needs to consider is the following: when a human is going through natural death, they go through similar experiences as a prisoner who is being executed. If you are modestly aware of your surroundings (not fully sedated), you would be aware of and possibly feel pain as your brain goes through oxygen deprivation and dies.&lt;br /&gt;&lt;br /&gt;As such, I postulate that:&lt;br /&gt;1. Either natural death is in violation of the constitution as it is cruel and unusual "punishment" (price you pay for living) and should not be allowed.&lt;br /&gt;2. Since the manner of suffering between natural death and execution by lethal injection are visited upon all without discrimination, then the suffering is not unusual and not cruel, so therefore is not unconstitutional.&lt;br /&gt;&lt;br /&gt;The other point to consider is did Michael Morales ensure that his victim, 17 year old Terri Winchell, did not suffer as he raped, strangled (unsuccessfully), bludgeoned (repeatedly), and stabbed (repeatedly)? If he made sure that she was fully sedated and could not feel anything, then he should be given clemency and a life sentence. Families of fallen soldiers and Marines are being told they have the option to have the government-furnished headstones engraved with "Operation Enduring Freedom" or "Operation Iraqi Freedom" at no extra charge, whether they are buried in Arlington or elsewhere. A mock-up shown to many families includes the operation names.&lt;br /&gt;The vast majority of military gravestones from other eras are inscribed with just the basic, required information: name, rank, military branch, date of death and, if applicable, the war and foreign country in which the person served.&lt;br /&gt;Families are supposed to have final approval over what goes on the tombstones. That hasn't always happened.&lt;br /&gt;Nadia and Robert McCaffrey, whose son Patrick was killed in Iraq in June 2004, said "Operation Iraqi Freedom" ended up on his government-supplied headstone in Oceanside, Calif., without family approval.&lt;br /&gt;"I was a little taken aback," Robert McCaffrey said, describing his reaction when he first saw the operation name on Patrick's tombstone. "They certainly didn't ask my wife; they didn't ask me." He said Patrick's widow told him she had not been asked either.&lt;br /&gt;"In one way, I feel it's taking advantage to a small degree," McCaffrey said. I think not. It is another case, my opinion, of AP publishing an Op / Ed piece under the guise of a news story. This family is suffering a great loss and my heart goes out to them. But they are using this loss for political capital. That is where my sympathy for this greiving family ends.&lt;br /&gt;&lt;br /&gt;Nadia McCaffery is interviewed &lt;a href="http://www.ktvu.com/video/4858934/detail.html"&gt;here&lt;/a&gt; (from KTVU website) talking about her intent to join Cindy Sheehan in Crawford for the "protest"... She is also a member of the &lt;a href="http://www.gsfp.org/article.php?id=85"&gt;GSFP&lt;/a&gt;, a "non-profit" organization that is acting more like a political group, which might be in violation of its non-profit status from the IRS. Gold Star Families for Peace is a front group founded by Cindy Sheehan to achieve a political means to ending the war.&lt;br /&gt;&lt;br /&gt;I fully support the President and his administration in the prosecution for the war on terror. I make no bones about it. It is such a shame that Nadia, Cindy and a few others are using the names and memories of the loved ones, ones who gave the ultimate sacrifice, for political means. I grieve for their loss and am grateful for the gift of freedom that their loved ones, along with so many others throughout history have given so that we all can have the freedom to debate the GWOT.&lt;br /&gt;&lt;br /&gt;If it wasn't for the sacrifice, none of us would be able to have that ability. CBS.&lt;br /&gt;What are the professions of the authors?  Lawyers.&lt;br /&gt;Who are lawyers obligated to protect? So it must come as a shock that there are still &lt;a href="http://www.usatoday.com/news/nation/2004-12-12-women-college_x.htm?csp=22_tnt"&gt;64 women's only colleges&lt;/a&gt;.  The Board of Trustees for Wells College in Aurora, NY has voted to admit men in the Fall of 2005.  Two female students of Wells have filed suit to keep the school women only. &lt;br /&gt;&lt;br /&gt;You might be surprised to hear me admit this, but I say, more power to the women!  If women choose to attend a single sex institution or organization, I say that is great.  I respect their decision and agree with their right to keep the tradition alive. This decision was made, in all likelyhood, with much thought about the consequences.&lt;br /&gt;&lt;br /&gt;Target has been a good corporate citizen, donating many millions of $ each year to a variety of worthy causes. As a long term guest of Target, and yes, I enjoy shopping there, I have a suggestion for Target. Why doesn't Target make a donation to the Salvation Army in the amount of $10,000,000. This would offset any losses that the Salvation Army is reporting because they are not able to canvass in front of Target. It would also demonstrate that Target does care, about what its guests want (not to be bothered by a lot of people asking for money, signatures, etc while I am trying to shop), while caring for the less fortunate ...&lt;br /&gt;&lt;br /&gt;If you agree with this, please send an email to &lt;a href="mailto:guest.relations@target.com"&gt;guest.relations@target.com&lt;/a&gt;. If they won’t let it happen, that’s ok, thanks for trying…...&lt;br /&gt;&lt;br /&gt;The least that we can do for Russell is to try to get this song played across this great land of ours. His funeral is on 12/15/2004 at 1:00 pm. Call your local radio station, tell them about this true story and request that they play this song for Russell, for all our troops and their families.
